Delivery of Controlled Substance
Generally, Delivery of a Controlled Substance in Washington is punishable as a felony upon conviction. The precise level of Felony charge depends on the defendant’s alleged actions and the alleged drug delivered (or attempted to be delivered). It is also a crime to deliver a substance in lieu of a controlled substance – essentially selling fake drugs. Delivery of fake controlled substances is a Class C Felony under RCW 69.50.4012. RCW 69.50.401 is the main Delivery of a controlled substance statute, which states that it is unlawful for any person to deliver or possess with intent to deliver, a controlled substance. Some of these crimes are punishable as Class B felonies, but most are punishable as Class C. An example of a Class B Felony charge: If a person delivers, or possesses with intent to deliver, a controlled substance classified in Schedule I or II which is a narcotic drug or flunitrazepam, including its salts, isomers, and salts of isomers, classified in Schedule IV, is that person (if convicted) isguilty of a class B felony.
