Possession of a Controlled Substance in Washington can be either a misdemeanor or a felony, depending on the substance, amount possessed, and what the intention of the person possessing it.
Possession of Marijuana less than 40 grams is typically a simple misdemeanor, unless the person possessed it with intent to distribute or sell it, in which case it is a felony.
Possession of a Legend Drug is likewise usually a simple misdemeanor, unless the person possessed it with intent to distribute or sell it, in which case it is a Class B felony.
RCW 69.50.4013 states that it is unlawful for any person to possess a controlled substance unless the substance was obtained directly from, or pursuant to, a valid prescription or order of a practitioner while acting in the course of his or her professional practice, or except as otherwise authorized by this chapter (such as less than 40 grams of marijuana).
Washington has classified "controlled substances" into "Schedules," which are Schedules I through IV.
"Controlled substance" means a drug, substance, or immediate precursor included in Schedules I through V as set forth in federal or state laws, or federal or board rules.
Chapter 69.50 of the RCW puts each criminalized drug into a Schedule. Violations typically fall into either a Class B or Class C Felony designation.
It is also unlawful to create, deliver, or possess a counterfeit substance, which may either be a Class B or Class C Felony.
